ONE ACCUSED CONVICTED IN A RAPE CASE.
By The Ld. Special Judge, Gomati Judicial District, Udaipur.
On 02-09-2021, the Ld. Special Judge, Gomati Judicial District, Udaipur has convicted 01 (One) accused person namely Maman Miah @ Idhar Ali (22) S/O Sri Sajal Miah of Tut Bagan, PS BRG, under Gomati District.
On 25-04-2019, Birganj PS Case No. 2019BRG028 U/S- 448/376(2)(I)/506 IPC and 4 of POCSO Act 2012, was registered on the basis of the Oral complaint by the complainant against accused person namely Maman Miah @ Idhar Ali (22) S/O Sri Sajal Miah of Tut Bagan, PS BRG, under Gomati District, to the effect that on 25-04-2019 at about 1000 hrs when the complainant in absence in her house, at that time the FIR named A/P entered into the house of the complainant and committed rape upon the minor daughter of the complainant.
During investigation the I.O of the case arrested the accused person and forwarded him to the Ld. Court. On completion of investigation, based on evidences, charge-sheet was filed by W/SI Sumitra Kapali, I.O of the case on 21-07-19, against the accused person namely Maman Miah @ Idhar Ali (22) S/O Sri Sajal Miah of Tut Bagan, PS BRG, under Gomati District. Vide Birganj PS C/S No. 40/2019 U/S- 448/376(2)(i)/506 IPC & 4 of POCSO Act 2012.
The trial Court on appreciation of evidence found the accused person namely Maman Miah @ Idhar Ali (22) guilty U/S 06 of POCSO Act 2012 and sentenced him to suffer rigorous imprisonment for 10 years and also to pay a fine of Rs-5,000/- In default of payment he shall undergo rigorous imprisonment for 03(Three) Months. The convict is further sentence to rigorous imprisonment for 01(One) month for commission of offence U/S 448 IPC. Both the sentence shall run concurrently.

On 13-02-2020, the Ld. District & Sessions Judge, Gomati District Udaipur, has convicted 02 (Two) accused persons namely (1) Sri Kastarai Tripura (30) S/O Lt. Kachakla Tripura of Ramchandra Reang Para PS Nutanbazar and (2) Sri Bhanjoy Tripura (23) S/O Lt. Ajoy Tripura of Ramchandra Reang Para PS Nutanbazar, under Gomati District U/S 376A/302/376D/363/201/120B & Section 6 of POCSO Act- 2012.
The fact of the case in brief is that On 06-12-2018, Nutanbazar PS Case No-2018NTB051 U/S-376(2)(i)/376(D)/302/201/34 IPC read with Section 06 of POCSO ACT, 2012 was registered on the basis of written complaint of Sri Tarani Kr. Tripura @ Tarin (22) S/O Sri Monoranjan Tripura of Krishna Kanta Para, PS Nutanbazar against the accused persons namely (1) Sri Kastarai Tripura (30) S/O Lt. Kachakla Tripura of Ramchandra Reang Para PS Nutanbazar and (2) Sri Bhanjoy Tripura (19) S/O Lt. Ajoy Tripura of Ramchandra Reang Para PS Nutanbazar, under Gomati District. The synopsis of the FIR was that both the accused criminally conspired and kidnapped the victim sister of the complainant namely Madhuri Tripura, 11 years (D/O Sri Monoranjan Tripura of Krishnakanta Para Bairagi Dokan PS Nutanbazar) on way to her School, then forcibly taken her to road side Jungle and committed gang Rape upon her. After commission of such aggravated sexual torture upon the minor victim they killed her and buried her dead body to conceal their Crime.
During investigation I.O of the case namely Dhrurajoti Dabbarma arrested the FIR named Accused persons on the weigh of evidence and forwarded them to Ld. Court. After investigation considering evidence, the I.O filed Charge-sheet vide Nutanbazar PS C/S No. 01/2019 dated 14-02-2019 U/S 120(B)/363/376(D)/302/201 of IPC & section 6 of POCSO Act- 2012.
The Ld. trial court on appreciation of evidence found both the accused guilty and imposed-
(i) Death sentence given to them for the offence U/S 376A with a fine amounting to Rs- 30,000/- in default of payment of fine, Rigorous Imprisonment for more 06 (Six) months.
(ii) Further, they have been sentenced to suffer death sentence for the offence U/S 302 IPC and also to pay fine amounting to Rs- 30,000/- in default of payment of fine, Rigorous Imprisonment for more 06 (Six) months.
(iii) Further, they have been sentence to Rigorous Imprisonment for life with fine amounting to Rs- 25,000/- for the offence U/S 376D of IPC. In default of payment of fine, they are to suffer Rigorous Imprisonment for more 03(Three) months.
(iv) Further, they have been sentence to suffer Rigorous Imprisonment 07 years and fine amounting to Rs- 10,000/- for the offence U/S 363 of IPC. In default of payment of fine, they are to suffer Rigorous Imprisonment for more 02(Two) months.
(v) Further, they have been sentence to suffer Rigorous Imprisonment 07 years and fine amounting to Rs- 10,000/- for the offence U/S 201 of IPC. In default of payment of fine, they are to suffer Rigorous Imprisonment for more 02(Two) months.
(vi) Further, they have been sentence to suffer Rigorous Imprisonment 07 years and fine amounting to Rs- 10,000/- for the offence U/S 120B of IPC. In default of payment of fine, they are to suffer Rigorous Imprisonment for more 02(Two) months.
(vii) Further, they have been sentence to suffer Rigorous Imprisonment 07 years and fine amounting to Rs- 10,000/- for the offence U/S 6 of the POCSO Act- 2012. In default of payment of fine, they are to suffer Rigorous Imprisonment for more 02(Two) months.
The Ld. Court finally observed that the fine money if realized, shall be paid to the victim’s father.
Such capital punishment of the accused of such gruesome act could be ensured due to sincere and skilled investigation of SI Dhrubajoyti Debbarma, I.O of the case. For such successful investigation the I.O of the case may be suitably rewarded.

The trial Court on appreciation of evidence found the accused person namely Arabinda Debnath & Arabindu (45) is guilty U/S U/S 354 IPC & 10 of Protection of Children from Sexual Offence Act- 2012. and sentenced him to suffer Rigorous Imprisonment for 05 (five) years and to pay a fine of Rs- 5,000/- for the punishable offence U/S 10 of Protection of Children from Sexual Offence Act- 2012 in default to pay to suffer simple Imprisonment for (3) three months and also sentenced to Rigorous Imprisonment for 06 (Six) months for the punishable offence U/S 354 IPC.

Today On 31-03-2018 the Ld. Addl. Session Judge Gomati District, Udaipur, has convicted one person namely Sri Singha Joy Reang (38) S/O Sri Katindra Reang of Chandra Sinh Para PS Karbook, Gomati Tripura District U/S 304(ii)/338 IPC.
On 19-06-2014 Birganj PS Case No. 2014BRG033 U/S- 279/338/304(ii)/427 IPC was registered Suo-moto compliant of ASI Shanti Ranjan Debnath of Birganj PS against the driver of vehicle B/No.TR-03-D-0255 (Maruti Suzuki Omni) for causing injury by Rash and Negligent driving on 19-06-2014 at about 0645 hrs at Amarpur to Nutanbazar road near Kawamara bridge, dashed the one motor bike B/No. TR-03-B-4586 (Hero Honda) resulting which rider of motor bike and pillion rider sustained grivious injuries. Then and then local public shifted them to Amarpur S.D Hospital thereafter referred to TSD Hospital Udaipur. On way one Nityananda Shil succumbed to his injuries and one Diparaj Shil admitted at TSD Hospital Udaipur.
During investigation I.O of the case arrested driver of offending vehicle and forwarded to Ld. Court. After investigation I.O of the case Inspector Sunil Kr. Das filed Charge-sheet on 31-10-2014 vide Birganj PS Charge Sheet No. 45/2014, U/S 279/338/304(ii)/427 IPC against the driver of offending vehicle namely Sri Singha Joy Reang (38) S/O Sri Katindra Reang of Chandra Sing Para PS Karbook, Gomati Tripura District.
The trial Court on appreciation of evidence found the accused person namely Sri Singha Joy Reang (38) is guilty U/S 304(ii)/338 IPC and sentenced him to suffer Rigorous imprisonment for a term of 01 (One) year & pay a fine of RS.2,00000/- in default to pay to suffer Rigorous imprisonment for 06 (Six) months for the Commission of offence punishable U/S 304(ii) IPC. Further the convict is sentence to suffer Rigorous imprisonment for 06 (Six) months and pay a fine of Rs- 10,000/- in default to pay to suffer simple imprisonment for 02 (Two) Months for the Commission of offence punishable U/S 338 IPC. The trial Court on appreciation of evidence found the accused person namely Sri Dipak Bhowmik is guilty U/S 326 IPC and sentenced him to suffer Rigorous Imprisonment for 02 (Two) years and pay fine of Rs- 5,000/- in default to pay of fine to suffer Rigorous Imprisonment 02(Two) months more.

On 07-12-2017 the Ld. J.M 1st Class Court No.03, Udaipur Gomati Tripura, has convicted one person namely Sri Sukanta Shil (28) S/O Sri Badal Shil of Munshipara Barpathari PS Bilonia, South Tripura District U/S 279/338 IPC.
On 23-05-2015 KKB PS Case No. 2015KKB045 U/S- 279/338 IPC was registered on the compliant of one Sri Ajit Chakraborty S/O Lt. Hari Mohan Chakraborty of No.02 Bipin Nagar Colony PS Kakraban Gomati Tripura District, against the Driver of vehicle B/No.TR-03-1338 (BUS) for causing injury by Rash and Negligent Driving on 18-05-2015 at about 0800 hrs dashed to the son of the complainant at Rani on Kakraban to Mirza road, as a result son of the complainant received grievous injuries on his person.
After investigation I.O of the case SI Bimal Das filed Charge-sheet on 31-08-2015 vide KKB PS C/S No. 53/2015, U/S 279/338 IPC & read with section 177/184 of M.V Act against the Driver of offending vehicle namely Sri Sukanta Shil (28) S/O Sri Badal Shil of Munshipara Barpathari PS Bilonia, South Tripura District.
The trial Court on appreciation of evidence found the accused person namely Sukanta Shil (28) is guilty U/S 279/338 IPC and sentenced to pay a fine of Rs. 500/- only for commission of offence U/S 279 IPC & to pay a fine of Rs. 500/- only for commission of offence U/S 338 IPC.

On 30-11-2017, The Ld. J.M 1st Class Court No. 03 Udaipur, Gomati District, has convicted 01 (One) accused person namely Sri Abdul Kader Miah (35) S/o Rajak Miah of Rani PS Kakraban under Gomati District.
On 13-02-2016, Kakraban PS Case No. 2016KKB011 U/S 498(A)/34 IPC, was registered on the basis of written complaint of the complainant against the accused persons namely (1) Sri Abdul Kader Miah (35) S/o Rajak Miah (2) Rajak Miah S/O Lt. Gafur Miah (3) Smt. Saru Bibi W/O Md Rajak Miah all of Rani PS Kakraban under Gomati District (4) Smt. Jyoshna Bibi D/O Md. Saddek Miah of Dugara PS Sonamura under Shipahijala District; for subjecting cruelty/torture upon the complainant at her matrimonial house at Rani PS kakraban over the issue of dowry demand.
After investigation, charge sheet was filed by SI Prabal Deb of Kakraban PS, I.O of the case; on 29-02-2016, against the accused persons. Vide Kakraban PS Charge Sheet No. 10/2016 U/S-498(A)/34 IPC.

On 15-12-2014, R.K.Pur Women PS Case No. 2014WRP147 U/S 325/307 IPC, was registered on the basis of written complaint of one Sri Manan Miah Khadim S/O Sri Abul Hossain Khadim of Khilpara, PS R.K.Pur against the accused persons namely (1) Sri Abdul Latif Palowan (27) S/o Lt. Abdul Ajij Palowan (2) Smt. Lavely Begam W/O Sri Abdul Latif Palowan (3) Smt. Sahara Bibi W/O Lt. Ajid Miah Palowan all of Khilpara PS R.K Pur under Gomati District; the fact of the case in brief is that on 14-12-2014 at about 1730 hrs. the mother of the complt. Smt. Fulmeher Bibi (50) Called to the FIR named A/P Smt. Sahara Bibi to her house and assaulted upon the mother with intention to kill her by wooden file as a result the mother of complt. received grievous injuries.
After investigation, charge sheet was filed by W/SI Shakuntala Debbarma of R.K.Pur Women PS, I.O of the case; on 28-02-2015, against the accused persons. Vide R.K.Pur Women PS Charge Sheet No. 13/2015 U/S-341/325/354/307/109 IPC.
