Imprisonment for Life of one  accused in 302 IPC case

Khowai, dated- 25/07/15

The Addl. District & Session Judge, Khowai has convicted to one accused person namely Kishore Jhara S/o Lt. Debthan Jhara of Lankapura Jharabasti, PS-Khowai for the charge of murder of his wife and sentence to suffer rigorous imprisonment of life with fine of Rs.3000/- in default to suffer imprisonment for six months for commission of an offence U/S 302 IPC.

The fact of the case in brief is that AP’s wife Smti. Gunabati Jhara was the ‘ASHA’ worker. She was not able to do paper works of ‘ASHA’ for which she used to take help of one Trimur Debbarma, husband of her co-worker Smti. Anita Debbarma. AP suspected that his wife might have illicit relation with Trimur Debbarma. On this issue regular quarrel used to take place in between AP and his wife (deceased).

On 24/03/2013 evening at about 1700 hours quarrel took place in between AP and the deceased on this issue. Suddenly AP Kishore Jhara started assaulting the deceased physically. Then to save her life deceased run away from her house and AP also run behind her with a ‘Dao’. In front of the kitchen of one Badalaxmi Jhara, AP started assaulting the deceased with ‘Dao’ on her head, hand and different parts of the body due to such assault deceased received serious blinding and cut injuries and died on spot.

On the basis ofarrow-10x10.png complaint of one Manik Lal Jhara S/o Shri Dhuki Lal Jhara of Belcharra, PS-Khowai a specific case vide Khowai PS Case No.39/2013 dated 24/03/13 U/S 302 IPC was registered by O/C, Khowai PS and endorsed the case to S.I.  L.L. Darlong to complete its investigation.

After completion of investigation, I.O. of the Case (S.I.  L.L. Darlong) submitted Charge-sheet vide No. 103/2013 dated 28/09/2013  u/s 302 IPC against the FIR named A.P. Kishore Jhara S/O Lt. Debthan Jhara of Lankapura Jharabasti, PS-Khowai.

The Trial Court found him guilty and convicted the AP.

Imprisonment for seven years to one accused in 302 IPC case

The Ld. Addl. District & Session Judge, Khowai has convicted one accused person Bishu Ghatwal S/O Lt Kala Chand Ghatwal of Bartilla Ps Champahour for the charge of murder and sentenced to seven years imprisonment under section 302 of Indian Penal Code.

On 10/01/13 night hot altercation took place in between victim (Wife of the AP) namely Dipali Ghatwal and AP (Husband of the victim) of the case namely Bishu Ghatwal S/O Lt Kala Chand Ghatwal of Bartilla PS Champahour on the issue of family matters while they were working in a rubber garden. Then AP Bishu Ghatwal assaulted his wife i.e victim of the case by lathi as a result of which she received grievous injuries on her person and she died in the same night. He spent night in that rubber garden. On the following day morning i.e on 11/01/13 morning AP himself brought the dead body of his wife to his home and subsequently he confessed his guilt. On this incident Champahour P.S case No-01/13 dated 11/01/2013 U/S-302 IPC was registered on the complaint of Sri Santosh Bhumij S/O Lt Chamthu Bhumij of Krishnapur PS Sidhai and endorsed the case to SI Pradip Debbarma of Champahour PS to complete its investigation.

After completion of the investigation I.O of the case submitted charge sheet against the FIR named A/P U/S- 302 IPC vide Champahour P.S C/S No-09/13 dated 30/04/13.

The trial court found him guilty and convicted him.

Imprisonment for life to one accused in 302 IPC case

Khowai. Dated -13/05/2015

The Ld. Addl. District & Session Judge, Khowai has convicted one accused person namely Madhusudhan Debbarma S/O Lt Khirode Debbarma of Jamtilla PS Khowai for the charge of murder and sentenced to suffer rigorous imprisonment for life with fine of Rs-1000/- in default to suffer simple imprisonment for two months for commission of an offence under section 302 of Indian Penal Code.

On 24/01/07 at about 0630 PM AP namely Madhusudhan Debbarma S/O Lt Khirode Debbarma of Jamtilla entered into the dwelling house of the victim and killed him by giving blow behind head by sharp cutting dao and fled away which was witnessed by the complt namely Tarun Debbarma S/O Lt Hemanta Debbarma of Kalaranjan Chowdhury para, a religious son of the victim. The incident happened due to dispute in between AP and victim on the issues of land dispute. On this information OC Khowai PS registered Khowai PS case no 07/07 U/S 302 IPC and endorsed the case to SI Shyamal Murasing of Khowai PS to complete its investigation. On his transfer the case was re-endorsed to SI Shyamal Debbarma and then to SI Ratan Debnath.

After completion of investigation of the case SI Ratan Debnath submitted charge sheet vide no 13/10 dated 28/04/10 against the FIR named AP Madhusudhan Debbarma S/O Lt Khirode Debbarma of Jamtilla PS Khowai.  

The trial court found him guilty and convicted him.

Imprisonment for one year to one accused in 453/380 IPC case

Khowai. Dated -19/05/2015

The Ld. SDJM, Khowai has convicted one accused person namely Raju Das S/O      Sanjit Das of Neajinagar, Teliamura PS Teliamura for the charge of theft and sentenced to suffer rigorous imprisonment for 01 (one) year with fine of Rs-500/- in default to suffer simple imprisonment for 10 (ten) days for commission of an offence under section 453/380 of Indian Penal Code.

On 28/06/14 midnight at any time AP namely Raju Das S/O Sanjit Das of Netalinagar, Teliamura entered into the shop of the complt and stolen away some stationary goods from complt’s shop situated at Totabari Bazar under Kalyanpur PS by breaking door of the shop. At dawn he was trying to flee away with the bootie which was witnessed by some villagers of that area and one of them informed OC KLN PS about AP’s suspicious movement with some baggage. On this information OC KLN PS with staff instantly rushed to the spot and detained the AP. After that OC Kalyanpur PS returned to PS, interrogated AP and recovered stolen goods like tobacco packets, Vasmol Kesh Kala, Bajaj Almond Drops hair oil, Colgate, Boro plus, Nirma Sandal Soap, Cigarette etc articles from AP’s possession. Then OC PS informed complt to come to PS and took a complt from shop keeper i.e complt and registered KLN PS case no 25/14 U/S 457/380 IPC and endorsed the case to SI Bishnu Ch. Das of Kalyanpur PS to complete its investigation.  

After completion of investigation of the case SI Bishnu Das submitted charge sheet vide no 26/14 dated 28/07/14 against the FIR named AP Raju Das S/O Sanjit Das of Netalinagar, Teliamura PS Teliamura.    

The trial court found him guilty and convicted him.

           Imprisonment for Life  of one  accused in 302 IPC case

The Addl. District & Session Judge, Khowai has convicted to one accused person namely Milan Debbarma  S/o Sonamani Debbarma of Gumsinghbari, PS-Champahour for the charge of murder of his wife and sentence to suffer rigorous imprisonment for life with fine of Rs.3000/- in default to suffer imprisonment for six months for commission of an offence U/S 302 IPC.

 

The fact of the case in brief is that Milan Debbarma S/o Sonamani Debbarma of Gumsinghbari, PS-Champahour was staying with his wife (victim) namely Sharmila Debbarma in the house of his father in law at Sukiabari. On 29.05.15 at about 0900 hrs AP and his wife went to kachha well to take bath which is situated North-West side from the house of Shri Sonamohan Debbarma S/o Lt. Mankorai Debbarma of Sukhiabari, complainant of the case. But they did not returned on the same day. Complainant and other nieghbours conducted search nearest probable place but to no good. On 02/06/14 at about 0800/0830 hours complainant and other villagers went out for searching in the forest near the kachha ringwell. During searching complainant and villagers found the dead body of his daughter in highly decomposed condition near the Vidyabill Panchayat lake. After that complainant lodged complaint to O/C, Champahour PS and a specific case vide No.07/2014 U/S 302/201 IPC was registered and O/C, Champahour PS Inspector Shyamal Debbarma took its investigation.

During investigation it was revealed that after marriage AP Milan Debbarma was staying in the house of his father-in-law with his wife. But they used to quarrel in between them frequently on the issue of family matters. On the day of incident also while they were taking bath AP physically assaulted his wife and subsequently AP pressed throat of his wife. After few minute she (deceased) became senseless and fell down the ground. After that AP carried her body on his solder and kept the body of the victim in the water of Vidyabill Panchayat lake and chopped on the neck of the victim by a ‘Dao’ which he was carrying with him to ensure death of her wife and then fled away from the house of his father-in-law.

After completion of investigation I.O. of the case Inspr. Syamal Debbarma, O/C, Champahour PS submitted charge-sheet vide No.12/2014 dated 30/10/2014 against AP Milan Debbarma S/o Sonamani Debbarma of Gumsinghbari PS-Champahour U/S 302/201 IPC with prayer of custodial trial.

The Trial Court found him guilty and convicted the AP Milan Debbaram S/o Sonamani Debbarma of Gumsinghbari PS-Champahour.

Imprisonment of one accused in 448/376 IPC case

 

The Addl.District and Session Judge, Khowai has convicted one accused person namely Sri Sanjit Debnath, S/O Sri Subhas Debnath of Kuchpara, P.S Kalyanpur for the charge of rape of a minor girl and sentenced the accused to suffer rigorous imprisonment for 1 year with fine of Rs 1000/- in default to suffer simple imprisonment for 2 months and also sentenced him to suffer rigorous imprisonment for 3 months for commission of offence u/s 448 of IPC.

         

The fact of the case in brief is that on 20.02.2013 the complainant alongwith his wife and daughter was sowing paddy for cultivation in their field. One of his minor daughter was sleeping in the lone house and taking advantage of her loneliness the accused namely Sri Sanjit Debnath, S/O Sri Subhas Debnath of Kuchpara ,P.S Kalyanpur forcefully committed rape upon her by pressing her mouth with napkin (gamcha). As the complainant arrived in his house, his daughter narrated the whole incident to him disclosing the name of the a/p.

         

On the basis of such complaint, kalyanpur P.S case No 06/13 U/S 448/376 IPC was registered and was endorsed to SI Bishnu Ch. Das for completion of its investigation. During investigation, the offence of committing rape to a minor girl was established beyond any reasonable doubt against the accused by virtue of the statement of witnesses and other scientific evidences. The Investigation officer SI Bishnu Ch. Das submitted charge sheet against the FIR named A/P Sri Sanjit Debnath, S/O Sri Subhas Debnath of Kuchpara, P.S Kalyanpur vide Kalyanpur P.S C/S No 12/2013 dated 31.05.2013 U/S 448/376/506 and Sec 4 of the POCSO Act .  

         

The trial court found the FIR named a/p Sri Sanjit Debnath, S/O Sri Subhas Debnath of Kuchpara, P.S Kalyanpur guilty of the offence and convicted him. The conviction restored the faith of common man in criminal justice system.

Imprisonment of one accused in 457/380/411 IPC case

 

The Sub-Divisional Judicial Magistrate, Khowai has convicted one accused person namely Sri Raja Das @ Raju (19), S/O Sri Sanjit Das of Laltilla P.S Teliamura for the charge of theft  and sentenced the accused to suffer rigorous imprisonment for 6 months with fine of Rs 500/- in default to suffer simple imprisonment for 10 days for commission of the offence.    

 

The fact of the case in brief is that on 29.07.2015 the nephew of the complainant namely Sri Nirod Das, S/O Ramani Mohan Das of West Howai Bari, P.S -Teliamura was returning from one marriage ceremony. While Sri Nirod Das reached near the shop of the complt., he noticed light inside the shop of the complt. At this Sri Nirod Das came forward and saw through the doors of the shop that one miscreant is committing theft inside the shop. In the mean time, Sri Nirod Das saw another person of the locality and called him there. Both of them witnessed the miscreant taking away money from the cash box of the shop and the mobile recharge vouchers. After that both of them called for other people and detained the miscreant namely Sri Raja Das @ Raju (19), S/O Sri Sanjit Das of Laltilla. On search, by the complt and other eye witnesses, cash money amounting Rs 50 alongwith mobile recharge vouchers was found in the possession of the FIR named A/P. The miscreant committed the theft by breaking the bamboo fencing.

 

On the basis of such complaint, Teliamura P.S case No 93/15 U/S 457/338 IPC was registered and was endorsed to SI Suman Ulla Kazi for completion of its investigation. During investigation, the commission of the offence of committing theft by breaking the bamboo fencing of the shop of the complt. was established beyond any reasonable doubt against the accused by virtue of the circumstantial evidences and statement of witnesses. The Investigation officer SI Suman Ulla Kazi submitted charge sheet against the FIR named A/P  Sri Raja Das @ Raju vide Teliamura P.S C/S No 80/2015 dated 30.08.2015 U/S 457/380/411 IPC.   

         

The trial court found the FIR named a/p Sri Raja Das @ Raju (19), S/O Sri Sanjit Das of Laltilla P.S Teliamura guilty of the offence and convicted him. The hard efforts by the Investigation officer led to the conviction of a habitual criminal Sri Raja Das @ Raju who was also earlier convicted in C/w Kalyanpur P.S Case No 25/14 U/S 457/380 IPC and sentenced to RI for 1 year with a fine of Rs 500/- by the same court.
